DSPS Student Rights

The Americans with Disabilities Act, Section 504 of the Rehabilitation Act and other regulations governing access to higher education, mandate that all qualified students with a disability will have access to classes, programs, services, activities, facilities, technology, media, and communication systems.

Title 5 of the Education Code, (55750 of Subchapter 8 of Chapter 6 of Division 6) requires that SBCC faculty and administration will establish and maintain fundamental academic requirements in a reasoned, deliberative manner, utilizing relevant expertise.

The Family Educational Rights and Privacy Act , Public Law 93-579, 20 U.S.C. 1232 (g), assures that all records maintained by DSPS personnel pertaining to the student's disabilities shall be protected from disclosure and shall be subject to all other requirements for handling of student records. However, the student's consent to release information is not required as long as the disclosure is to other school officials, including instructors, within the college, whom SBCC has determined to have legitimate educational interests. Pursuant to Section 7 of the Family Educational Rights and Privacy Act; 5 U.S.C. 552a, the student will provide his/her social security number only on a voluntary basis.
